Terms of service
These Terms of Use ("Terms") apply to all relationships between the user ("User") and our company ("Company") concerning the use of this service ("Service").
In addition to these Terms, the Company may establish various rules and regulations for the use of the Service (hereinafter referred to as "Individual Provisions"). Regardless of their names, these Individual Provisions shall constitute a part of these Terms.
In the event of any inconsistency between the provisions of these Terms and the Individual Provisions, the Individual Provisions shall prevail unless otherwise specified.
Article 2 (User Registration)
To use the Service, an applicant must agree to these Terms, apply for user registration in the manner prescribed by the Company, and receive approval from the Company to complete the registration.
The Company may refuse to approve a user registration application if it determines that any of the following circumstances apply, and it shall have no obligation to disclose the reasons:
- False information was provided during the registration application.
- The application is from an individual who has previously violated these Terms.
- Any other reason the Company deems the registration inappropriate.
Article 3 (Management of User ID and Password)
Users are responsible for appropriately managing their User ID and password for the Service.
Under no circumstances may Users transfer or lend their User ID and password to third parties or share them with third parties. The Company will consider any login using a combination of User ID and password that matches the registered information as use by the User who registered that User ID.
The Company shall not be liable for any damages arising from the use of a User ID and password by a third party unless the Company has acted intentionally or with gross negligence.
Article 4 (Usage Fees and Payment Methods)
As consideration for the paid portions of the Service, Users shall pay the usage fees separately determined and displayed on the Company's website, using the method specified by the Company.
If a User delays payment of the usage fees, the User shall pay late damages at a rate of 14.6% per annum.
Article 5 (Prohibited Actions)
Users shall not engage in the following actions when using the Service:
- Actions that violate laws or public order and morals.
- Actions related to criminal activities.
- Actions that infringe intellectual property rights, such as copyrights or trademarks, contained in the Service.
- Actions that destroy or interfere with the functionality of the Company's or third parties' servers or networks.
- Actions that use information obtained through the Service for commercial purposes.
- Actions that may interfere with the operation of the Company's services.
- Unauthorized access or attempts to gain unauthorized access.
- Actions that collect or accumulate personal information of other Users.
- Actions that use the Service for fraudulent purposes.
- Actions that cause disadvantage, damage, or discomfort to other Users or third parties.
- Impersonation of other Users.
- Advertising, solicitation, or business activities on the Service without the Company's permission.
- Actions aimed at meeting unacquainted individuals of the opposite sex.
- Actions that provide benefits directly or indirectly to antisocial forces in connection with the Company's services.
- Any other actions the Company deems inappropriate.
Article 6 (Suspension of Service Provision)
The Company may suspend or interrupt the provision of all or part of the Service without prior notice to the User if it determines any of the following circumstances apply:
- Maintenance or updates of the computer system related to the Service.
- Difficulty in providing the Service due to force majeure events such as earthquakes, lightning, fires, power outages, or natural disasters.
- Suspension of computers or communication lines due to accidents.
- Any other reason the Company deems it difficult to provide the Service.
The Company shall not be liable for any disadvantages or damages incurred by Users or third parties due to the suspension or interruption of the Service.
Article 7 (Usage Restrictions and Deregistration)
The Company may, without prior notice, restrict the use of all or part of the Service or deregister a User if any of the following circumstances apply:
- Violation of any provision of these Terms.
- Discovery of false facts in the registered information.
- Default on payment obligations such as fees.
- No response to communications from the Company for a certain period.
- No use of the Service for a certain period since the last use.
- Any other reason the Company deems the use of the Service inappropriate.
The Company shall not be liable for any damages incurred by the User due to actions taken by the Company under this Article.
Article 8 (Withdrawal)
Users may withdraw from the Service by following the withdrawal procedures prescribed by the Company.
Article 9 (Disclaimer of Warranties and Limitation of Liability)
The Company does not expressly or impliedly warrant that the Service is free from defects, including but not limited to safety, reliability, accuracy, completeness, effectiveness, fitness for a particular purpose, or security.
The Company shall not be liable for any damages arising from the Service, except in cases of intentional or gross negligence by the Company. However, if the contract between the Company and the User regarding the Service (including these Terms) constitutes a consumer contract under the Consumer Contract Act, this disclaimer shall not apply.
Even in the case specified in the proviso of the preceding paragraph, the Company shall not be liable for any damages arising from special circumstances (including cases where the Company or the User foresaw or could have foreseen the occurrence of damages) resulting from the Company's negligence (excluding gross negligence). Additionally, compensation for damages arising from the Company's negligence (excluding gross negligence) shall be limited to the amount of usage fees received from the User in the month the damages occurred.
The Company shall not be involved in or responsible for any transactions, communications, or disputes between Users and other Users or third parties concerning the Service.
Article 10 (Changes to Service Content)
The Company may change, add, or discontinue the content of the Service with prior notice to Users, and Users shall agree to such changes.
Article 11 (Changes to Terms of Use)
The Company may change these Terms without individual consent from Users in the following cases:
- When the change to the Terms benefits the general interests of Users.
- When the change to the Terms does not contradict the purpose of the Service usage contract, and the necessity of the change, the appropriateness of the content after the change, and other circumstances related to the change make it reasonable.
The Company shall notify Users in advance of any changes to these Terms, the content of the changed Terms, and the effective date of the changes.
Article 12 (Handling of Personal Information)
The Company shall appropriately handle personal information obtained through the use of the Service in accordance with the Company's Privacy Policy.
Article 13 (Notices and Communications)
Notices or communications between Users and the Company shall be conducted in the manner prescribed by the Company. Unless a User submits a change notification in a manner separately determined by the Company, the Company will consider the currently registered contact information as valid and send notices or communications to that contact information, which shall be deemed to have reached the User at the time of dispatch.
Article 14 (Prohibition of Assignment of Rights and Obligations)
Users may not transfer or pledge their contractual status or rights and obligations under these Terms to third parties without the prior written consent of the Company.
Article 15 (Governing Law and Jurisdiction)
The interpretation of these Terms shall be governed by Japanese law.
In the event of any disputes arising concerning the Service, the court having jurisdiction over the location of the Company's headquarters shall have exclusive jurisdiction.
